Terms and Conditions for the Baze Live Platform
These terms and conditions govern your access and use of the Baze Live Platform and by accessing content on this platform, you will be deemed to have read, understood and accepted the same:
1. The Baze Live Service and Your Agreement to These Terms
- 1.1 Baze Live is an on-demand streaming service, offering entertainment videos, including TV shows, movies, video or audio clips, and other audio-visual content (the "Content") and is provided to you by Safaricom PLC.
- 1.2 This Content can be streamed on various electronic devices, such as personal computers, mobile phones, tablets, media players, smart TVs, set-top boxes, gaming consoles, and similar devices (the "Access Device"), as further detailed in clause 6 of these terms.
- 1.3 These Baze Live terms and conditions are available on Baze Live Terms.
- 1.4 These terms are presented alongside our privacy policy, which you can access at Privacy Policy.
- 1.5 The general terms of use for the Baze Live website are available at Website Terms of Use, covering the Baze Live website and any other URLs Baze Live might use for providing the service.
- 1.6 The Baze Live Application End User Licence Agreement can be accessed at Licence Agreement.
- 1.7 By agreeing to these terms, you also agree to the Privacy Policy, Website Terms of Use, and Licence Agreement, as though they were fully included in these terms.
- 1.8 When you create your account, you must accept these terms. If you do not agree to these terms, you will be unable to access the Baze Live service or its Content. Using the service or Content implies your acceptance of these terms. If you do not agree, you must stop using the service and Content immediately.
- 1.9 These terms, along with any referenced documents, constitute a binding legal agreement between you and Safaricom PLC (the "Agreement"). This Agreement remains effective until terminated by either you or us, as outlined in these terms.
- 1.10 Depending on your residence, the Baze Live service is provided by Baze Live KE Ltd (company registration number: 2022/672391/07), a company registered and incorporated under the laws of the Republic of Kenya.
- 1.11 The applicable governing law for these terms is the laws of Kenya.
2. Changes to the Baze Live Terms
- 2.1 We reserve the right to modify or vary or withdraw these terms at our sole discretion.
- 2.2 Customer will be notified of any changes. This notification may come via email, SMS, a pop-up notice when you access the Baze Live Service or the Baze Live Website, a pop-up notice when you log into your Baze Live Account (created upon registration), or through the Baze Live App.
- 2.3 A "Customer" is someone who has registered for the Baze Live Service through the prescribed process, has at least one active subscription plan (including any Free Trial plan, if available), and whose registration has been accepted by Safaricom.
- 2.4 If you are not a Customer, any changes to these terms will be effective immediately upon being posted on the Baze Live Website. It is your responsibility to review these terms (including any updates) whenever you wish to use the Baze Live Service or access the Content.
- 2.5 By continuing to use the Baze Live Service after being notified of changes to the Baze Live Terms, you are deemed to have accepted the amended terms. If you do not agree with any changes, you must discontinue using the Baze Live Service as outlined in clause 14.1 below.
3. Who May Use the Baze Live Service?
- 3.1 You may only use the Baze Live Service if:
- (a) you comply with these terms and conditions.
- (b) You are a customer; or
- (c) You are an Authorized User, meaning you have been permitted by a customer to access or use the Baze Live Service through their Baze Live Account (including one of its profiles). If you are an Authorized User, your rights to use the service will end when the Customer's rights end or if the Customer stops granting you access.
- 3.2 The Customer must ensure that all Authorized Users who access or use the Baze Live Service through the Customer's account are aware of, agree to, and comply with these Baze Live Terms.
- 3.3 All actions and omissions of Authorized Users will be considered (i) the actions and omissions of the Customer whose account they use, and (ii) the actions and omissions of other Authorized Users of that account. Similarly, all actions and omissions of a customer will be considered the actions and omissions of the Authorized Users who access the service through that Customer's account. This includes any breaches of these terms.
- 3.4 You must be 18 years or older to register for the Baze Live Service and should not attempt to register if you are under 18.
- 3.5 If an Authorized User is under 18, they must have permission from a parent or legal guardian to use the Baze Live Service and agree to these terms. They must also use the service under the supervision of the Customer or another Authorized User who is 18 or older.
- 3.6 We reserve the right, at our sole discretion, to refuse registration or use of the Baze Live Service. This applies even if you complete the registration process and agree to these terms.
- 3.7 We are not obligated to provide reasons if we refuse to let you register or use the Baze Live Service.
4. Your Information and Details
- 4.1 All information you provide to us must be truthful, accurate, and complete. This includes information given during registration and any updates provided later.
- 4.2 You must inform us if your information changes, if the details we have are incorrect, or if they are incomplete. If you don't update us, we will continue to use and rely on the most recent details you provided.
- 4.3 Customers can edit their details by logging into their Baze Live Account through the Baze Live Service or by contacting customer support at help@live.baze.co.ke. We will send a confirmation via email or SMS for any updates or changes made to the Customer's details. Additional information may be required to identify you as the Customer.
- 4.4 Please refer to our Privacy Policy for more information on how we use your information and your rights and responsibilities.
5. Keep Your Baze Live Account, Payment Details, Password, and User Credentials Secure
- 5.1 After registering on the Baze Live Website or Baze Live App, we will create your Baze Live Account. You will need your name, surname, email address, cell phone number, and password to access your account and use the service, or any other user credentials as may be required.
- 5.2 You are responsible for the use of your Baze Live Account, password, and other user credentials (such as social media login details used to access the Baze Live Service, if applicable).
- 5.3 Any use of the Baze Live Service or other actions performed with your password, Baze Live Account, or user credentials will be treated as if done by you and with your approval.
- 5.4 It is your responsibility to ensure you take all reasonable measures to keep your password, user credentials, payment details, and payment information (such as bank account or credit card details) secure and confidential.
- 5.5 If you suspect unauthorized access to your Baze Live Account, password, user credentials, payment information, or payment details, you must notify us immediately at help@live.baze.co.ke. You should also notify us of any unauthorized use of these credentials. You are responsible for changing your privacy settings, password, user credentials, and payment details as soon as possible.
